Terms of service

Please carefully read these Terms and Conditions (“Terms”) before using the website or engaging in the services offered by Dressed For Dinner.  These Terms set out the legally binding terms of service for your use of the website at www.dressedfordinner.co.nz and the services provided by Dressed For Dinner.

 

1. Definitions

1.1.     “We”, “us”, and “our” means Dressed For Dinner.

1.2.     “Terms” means these Terms and Conditions

1.3.     “Website” means the Dressed For Dinner website at www.dressedfordinner.co.nz

1.4.     “Services” mean the services provided by Dressed For Dinner

1.5.     “You” or “your” means a person who uses our website or engages in our services.

 

2. Introduction

2.1.     Dressed For Dinner is a business that provides a service for customers to rent garments.

2.2.     In using our website in any way (including but not limited to browsing the website), or by renting something from us, you are engaging in our services and therefore you agree to these Terms, including any additional policies referenced herein and/or available by hyperlink.

2.3.     If you do not agree to all Terms, then you are required to exit from this website immediately and not to engage with us or the Services we provide.

2.4.     Any new features or tools that are added to our website shall also be subject to these Terms.

2.5.     You can review the most current version of the Terms at any time on our website.

2.6.     We reserve the right to update, change or amend any part of these Terms from time to time, with or without notice to you and at our sole discretion.  Your continued use of our website or engaging in our services implies the acceptance of these updates, changes, or amendments.  It is up to you to review the Terms when using our website or engaging our services.

2.7.     There are some services and/or sections of our website and/or triggers that are subject to additional terms of service and/or policies.  These are included below via hyperlink, all of which form part of these Terms.  If there is any conflict between these Terms and the below additional terms of service and/or policies, unless it is specifically stated in these Terms, the individual terms of service and/or policies below will override.

2.7.1.     Privacy Policy

2.8.     We reserve the right to refuse service to anyone for any reason at any time.  We also reserve the right to cancel any order at any time.  In the event that we cancel an order, we may attempt to notify you by contacting the e-mail or billing address or phone number provided at the time the order was made.

2.9.     The headings used in these Terms are included for convenience only and will not limited or otherwise affect these Terms.

2.10.  These Terms are governed in accordance with the laws of New Zealand.

 

3. Products or Services

3.1.     When you rent a garment from us, this does not mean that you own or have any title to the item – Dressed For Dinner shall retain full ownership of the item.

3.2.     We have made every attempt to accurately describe the garments including the provision of photographs.  We ask that you choose your garment(s) carefully as we do not offer refunds or store credits should you change your mind, the garment does not fit, you do not think it suits you, if you do not like the colour, or it appears slightly different in colour and style than the images shown on the website. 

3.3.     All descriptions of the garments are subject to change at any time without notice at our sole discretion.

3.4.     We reserve the right to discontinue any product or service at any time without notice.

3.5.     We do not warrant that the quality of any products, services, information or other material purchased or obtained by you will meet your expectations, or that any errors in our Service will be corrected.

3.6.     We reserve the right to request proof of identity for orders we deem high value (to prevent the use of fraudulent credit cards, or other payment types).  Orders containing three or more garments may potentially be subject to this request.  If we cannot confirm the authenticity of the request, the order may be cancelled at our sole discretion.  We will attempt to make contact with you regarding the cancelled order.  

 

4. Cancellations and Refunds

4.1.     There is a lot of preparation (such as cleaning) that must be done before a rental is dispatched, and as well as that, someone who may have wanted the garment would not have been able to book it during the time before the rental was cancelled.  This is why in some cases we need to charge a small admin fee when a rental is cancelled.

4.2.     If you wish to cancel an order, a cancellation request must be emailed to us within the below time frames:

4.2.1.    If the cancellation is at least five (5) days before your event date, you are entitled to a full refund;

4.2.2.    If the cancellation is less than five (5) days before your event date, and so long as the item has not been couriered to you, you are entitled to a full refund less $20; or

4.2.3.    If the cancellation comes in after the item has been couriered to you, the rental is not able to be cancelled.

4.3.     If you do not pick up the rental you booked, a refund will not be available.

4.4.     We reserve the right to deny refunds, or store credit, for items that have not arrived in time for your event.  If your item has not arrived in time, we will investigate the tracking updates, and assess the situation in light of any unforeseeable events that could have delayed postage or operational failures by our courier partner.  Refunds and store-credits will be determined on a case-by-case basis, at our full discretion.

 

5. Try-ons

5.1.     Try-ons are by appointment only, we do not accept walk-ins.

5.2.     You are required to pay a non-refundable booking fee of NZD$5.00 to confirm your appointment.  This fee is to prevent no-shows, late cancellations, and to compensate for our time and extra care put into every appointment.  

5.3.     Appointment slots are 30 minutes long, if you need longer than this please contact us.

5.4.     The non-refundable booking fee will be deducted from your rental cost if you rent from us within four weeks of your try-on. 

5.5.     Try on appointments take place at a private residence and address details will be emailed to you upon appointment confirmation.

5.6.     You will be liable for any damage that occurs during a try-on, to our garments, fixtures, or premises.

5.7.     Postal try-ons are not available.

 

6. Garment Care

6.1.     We want you to enjoy the garment, but we also want the next customer to enjoy it as well, so we therefore would hope you treat the garment with the utmost care.

6.2.     Although you may not be the first to wear a garment, we do everything we can to keep it in the most pristine condition.  Please be mindful of embellished clutches or jewellery that may snag the material and avoid spray perfumes or beauty sprays directly onto the material. 

6.3.     Please do not attempt to fit into a dress that is not the right size for you, we will always endeavour to mention in the garment description if it runs smaller than the label suggests.

6.4.     We take care of all cleaning with our preferred methods to ensure the garment remains in the best condition possible.

6.5.     While are garments are in your care, please do not wash, dry clean, alter, fix, or remove/attempt to remove any stains.

6.6.     If we deem the garment(s) to have been improperly used in your care, then we reserve the right to charge you – refer to clause 9 below for more information on this.

6.7.     You should inspect the garment upon delivery and shall, within four (4) hours of receipt of the garment, notify us (by phone or email) of any alleged discrepancy in quantity, quality, style, damage or failure to provide the item as consistent with what was ordered.

 

7. Shipping and Returns

7.1.     We have flat fee shipping rates (as at 14.04.2023) for all orders as follows:

7.1.1.     New Zealand wide – Overnight (includes a return bag) - $15.00

7.1.2.     Pick up from Kaiapoi (with a return bag) - $7.50

7.2.     Our shipping rates are subject to change without notice.

7.3.     We use New Zealand Post as a courier service and all tracking numbers will be sent when they are shipped to enable you to track your order.

7.4.     We reserve the right to charge you additional shipping fees if you have not identified the right rate.

7.5.     We endeavour to courier the garment(s) to you in plenty of time, but we cannot guarantee delivery of your item by your desired date. 

7.6.     If you selected the pick-up option, we will send you an email or text when your order is ready for collection.  Please note that there may be certain times your order can be picked up, which will be detailed in our email or text to you.

7.7.     You will be provided with a return bag in which you will put your garment into a send back to us the next working day after your event.  You must hand this in person over the counter at your nearest post shop – do not place the return bag in a post box.  This enables the tracking to be scanned and logged so we can track the return.

7.8.     If you select the pickup and drop off option, you are obliged to return the garment yourself to us within two working days of your event.

 

8. Pricing

8.1.     Our prices are stated in New Zealand Dollars (NZD).

8.2.     We reserve the right to change the prices on our products without notice.  We are not responsible for any changes in price of our garments.   

 

9. Damage, late fees, and non-returns

9.1.     Prices detailed on our website do not include any damage that may occur to the garment while in your control (e.g. hard to remove stains, rips, etc.).  Upon return, if we find that the garment is damaged, we will email you an invoice to cover the cost of either the repair (if the garment is able to be repaired), or replacement (if the garment is damaged beyond repair).  

9.1.1.    For garments able to be repaired - all damage and fees incurred will be assessed and charged on a case-by-case basis. 

9.1.2.    For garments damaged beyond repair - the cost of replacement will be based on the Recommended Retail Price (RPP) of the garment.  We hold RRP details for all our garments, please contact us should you require this information prior to using our Services.  By engaging in our services (even if you failed to request the RRP information prior), you agree to pay the full RRP of the garment should the garment be damaged beyond repair as per this clause.

9.2.     As stated in clause 6.6, if you are returning the garment using the return courier bag, you are required to return your garment the next working day after your event.  Once you return your garment to a NZ Post office, your tracking will appear online, and we are able to track it with our courier partner.  If you do not return your garment within this specified time frame, you will be charged a fee of $20.00 for every working day it is late.  We will prepare an invoice and forward this to you for payment. 

9.3.     As stated in clause 6.7, if you are dropping off the garment to our Kaiapoi address, you are required to return your garment within two working days after your event.  If you do not return your garment within this specified time frame, you will be charged a fee of $20.00 for every working day it is late.  We will prepare an invoice and forward this to you for payment. 

9.4.     If a garment is not returned after 10 working days, we will consider the garment a “non-return” and will prepare an invoice and forward this to you for the balance amount to cover the full RRP.  If the amount paid exceeds the RRP, no further amounts will be sought and the amount exceeding the RRP will not be refunded.  We hold RRP details for all our garments, please contact us should you require this information prior to using our Services.  By engaging in our services (even if you failed to request the RRP information prior), you agree to pay the full RRP of the garment should the garment not be returned as per this clause.

9.5.     If any outstanding amounts owed to Dressed For Dinner are not paid when due, we will need to initiate third-party collection procedures via a collection agency as nominated at our discretion.  You agree to pay our costs of collection (including but not limited to internal administration fees, legal costs, collection agency costs, and bank fees), in addition to the outstanding amounts.

 

10. Accuracy, completeness, and timeliness of information

10.1.  You agree to provide current, complete, and accurate information when placing an order.  You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

10.2.  Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability.  We reserve the right to correct any errors, inaccuracies, and omissions and to change or update information or cancel orders if any information on our website is inaccurate at any time without prior notice (including after you have submitted your order).

10.3.  We have no obligation to update, amend, or clarify information on our website, including without limitation, pricing information, except as required by law. 

10.4.  The material on our website is provided for general information only and should not be replied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information.  Any reliance on the material, especially historical material, on our website is at your own risk.

10.5.  We reserve the right to modify the contents of our website at any time without notice, and whilst we will endeavour to keep our website as up to date as possible, we at no time provide any guarantee that the information on our website is up to date.

 

11. Third Party Links

11.1.  Certain content, products and services may include materials from third parties. Third-party links on our website may direct you to third-party websites that are not affiliated with us. 

11.2.  We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

11.3.  We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites.  Please review carefully the third-party’s policies and practices before you engage in any transactions. 

11.4.  Any complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

11.5.  By using our Services, you agree to indemnify Dressed For Dinner and its officers and agents from any claims, damages, losses, liabilities, and all legal costs resulting directly or indirectly from a claim by a third-party that is based on your use of the Services in violation of these Terms.

 

12. Media and Comments

12.1.  We do not allow you to use any of our images without our prior written consent.

12.2.  Upon sending or tagging Dressed For Dinner in photos or videos, we may use them for marketing and/or social media purposes.

12.3.  If, at our request, you send certain specific submissions (for example, contest entries), or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, or otherwise (collectively “comments”), you agree that we may at any time without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

12.4.  We are and shall be under no obligation to:

12.4.1.     Maintain any comments in confidence;

12.4.2.     Pay or compensate for any comments; or

12.4.3.     Respond to any comments.

12.5.  We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion as unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms.

12.6.  You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right.  You further agree that your comments will not contain libellous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website.  You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments.  You are solely responsible for any comments you make and their accuracy.  We take no responsibility and assume no liability for any comments posted by you or any third-party.

 

13. Unlawful Actions

13.1.  You may not use any of our garments for any illegal or unauthorised purpose, nor may you, in the use of our Services, violate any laws.

13.2.  Any attempt to steal garments will be dealt with by law enforcement.

13.3.  Any breach or violation of these Terms will result in immediate termination of our Services and may results in us taking legal action against you.

 

14. Severability

14.1.  In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extend permitted by the applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
